According to article 57 of the 1983 constitution, which despite numerous revisions is still in effect, the National People's Congress is the highest organ of government in the People's Republic of China. That notwithstanding, article 7 of the preamble reads:

"Under the leadership of the Communist Party of China and the guidance of Marxism- Leninism and Mao Zedong Thought, the Chinese people of all nationalities will continue to adhere to the people's democratic dictatorship and follow the socialist road…" In other words, " the constitutional elements of the political system so designated are the leadership role of the CCP and the instrumental character of the state.
